1. Acceptance of Terms
By accessing or using the website esimnote.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Private Entity Status
eSimNote operates as a private website and service provider. We reserve the absolute right to refuse service, terminate accounts, or block access to anyone for any reason at our sole discretion, without prior notice or liability.
3. Free Trial Policy (Strict)
Our "Free 1GB Trial" is a promotional offer subject to strict availability and eligibility requirements.
- One Per Person: The Free Trial is strictly limited to one (1) redemption per unique visitor, device, IP address, or email address.
- Stock Availability: Free eSIM profiles are issued from a limited pool. If our daily allocation is exhausted, no code will be issued, even if the user completes the setup steps.
- Verification: We reserve the right to require social verification (shares) or other human-verification steps. If these steps are bypassed or manipulated (e.g., using bots), the trial will be voided.
- No Entitlement: The Free Trial has no cash value. You have no legal entitlement to receive the free service if our system rejects your request.
4. Purchases & Refunds
For paid data plans:
- Final Sale: Due to the digital nature of eSIM QR codes, once a code has been scanned or downloaded, it cannot be refunded.
- Non-Delivery: If you purchase a plan and do not receive the QR code within 2 hours, you are eligible for a full refund or a replacement.
- Compatibility: It is the user's responsibility to ensure their device is eSIM compatible. We do not offer refunds for incompatible devices.
5. User Conduct
You agree not to use the Service to:
- Generate false traffic, bots, or automated scripts to claim multiple free trials.
- Attempt to bypass our security or verification systems.
- Resell or redistribute our eSIM profiles without written permission.
Any violation of these rules will result in an immediate permanent ban.
6. Limitation of Liability
To the maximum extent permitted by applicable law, eSimNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or connectivity while traveling.
- Missed flights, travel disruptions, or inability to access maps/services due to network downtime.
- Costs incurred from using alternative roaming providers.
Our total liability for any claim arising out of these terms shall not exceed the amount you paid to us (if any) in the last 12 months.
7. No Warranties ("As Is")
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. eSimNote makes no representations or warranties of any kind, express or implied, regarding:
- The availability or uptime of the Service.
- The speed or coverage quality of partner networks (AT&T, Vodafone, etc.).
- The availability of Free Trial stock.
8. Modifications
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
